MiraFeld Terms and Conditions
Effective Date: 7 April 2026

These Terms and Conditions (“Terms”) govern your use of the MiraFeld website and online store (“Site”) and the purchase and use of any products, artwork, or licences offered by MiraFeld (“we”, “us”, “our”).

By accessing the Site or placing an order, you agree to be bound by these Terms.

1. About MiraFeld

MiraFeld (ABN: 56 676 958 608) is based in New South Wales, Australia and offers original artwork, digital designs, and licence-based usage rights (collectively, “Products”).

2. Eligibility

By using the Site or placing an order, you represent that you:

  • are at least 18 years old; or

  • are using the Site with the consent and supervision of a parent or legal guardian.

3. Products and Licence-Based Use

MiraFeld Products include:

  • digital designs supplied under licence (personal, business, or merchandise); and

  • physical artwork (including prints and original works).

All designs are licensed, not sold, and remain the intellectual property of MiraFeld.

All use of designs is governed by the applicable licence agreement provided at the time of purchase.

Default Licence types for physical artworks:

Unless otherwise stated on the product page or agreed in writing: 

  • Standard prints are supplied with a non-exclusive Personal usage Licence, which allows personal, non commercial display only and does not prevent MiraFeld from selling the same print or artwork to other customers 

  • Original physical artworks (such as original paintings) are supplied with an Exclusive Personal Usage Licence by default, which allows the purchaser exclusive personal , non-commercial use of that specific artwork. 

Any business branding or merchandise use of an artwork (whether print, original, or digital file) requires a separate Business or Merchandise Usage Licence and is not included in the default Licences above.

Licence Priority and Scope

If there is any inconsistency between these Terms and a specific licence agreement, the licence agreement prevails to the extent of the inconsistency.

All licences are personal to you, non-transferable, non-sublicensable, and granted worldwide unless otherwise stated.

Licences are granted on a perpetual basis unless terminated in accordance with their terms.

You agree to comply with the applicable licence at all times.

4. Exclusivity and Availability

Where a Product is sold with an exclusive licence:

  • the design is licensed to one customer only;

  • it is removed from sale once purchased; and

  • MiraFeld will not license the same design to any other party.

MiraFeld retains the right to:

  • display the design in portfolios, on the Site, and in promotional materials; and

  • identify the licensee for attribution or case study purposes, unless otherwise agreed in writing.

You may request that we do not identify you in public case studies, and we will take reasonable steps to respect that request.

5. Orders and Payment

All prices are listed in AUD unless otherwise stated.

Full payment is required at the time of purchase.

Orders are processed once payment has been successfully received.

MiraFeld reserves the right to refuse or cancel any order where reasonably necessary, including in cases of pricing errors, suspected misuse, or fraudulent activity.

6. Digital Delivery

Digital Products are delivered via download link, email, or another agreed method.

You are responsible for securely storing all files after delivery. MiraFeld is not responsible for loss of files after successful delivery.

7. Shipping and Physical Artwork

MiraFeld currently ships physical artwork within Australia only:

  • Shipping costs and delivery estimates are provided at checkout.

  • Risk in physical goods passes to you upon delivery to the address provided in your order.

  • If an item arrives damaged, defective, or incorrect, you must contact us as soon as reasonably possible, preferably within 7 days of delivery and with photos of the issue.

All issues relating to damaged or faulty goods are handled in accordance with the MiraFeld Refund Policy and your rights under Australian Consumer Law.

MiraFeld may expand to international shipping in the future, and these Terms will apply subject to any additional conditions communicated at that time.

8. Refunds and Australian Consumer Law

Refunds, repairs, and replacements are handled in accordance with the MiraFeld Refund Policy.

  • Digital Products are generally non-refundable once accessed or downloaded.

  • If a refund is granted for a digital Product, any associated licence is immediately terminated and you must stop using the design and delete all copies.

  • Physical goods are covered by guarantees under Australian Consumer Law.

Nothing in these Terms excludes, restricts, or modifies any rights you have under Australian Consumer Law.

9. Intellectual Property

All intellectual property rights in MiraFeld Products remain with MiraFeld.

You must not:

  • copy, reproduce, distribute, or exploit any design outside the scope of your licence;

  • resell, sublicense, or transfer your licence; or

  • claim ownership or authorship of any design.

Unauthorised use may result in termination of your licence and legal action.

Any trademark use of design requires written consent and is governed by the relevant Licence. 

10. Website Use

You agree not to:

  • misuse the Site or its content;

  • attempt to gain unauthorised access to systems or data;

  • interfere with the operation of the Site; or

  • use the Site for unlawful purposes.

If you create an account, you are responsible for maintaining the confidentiality of your login details.

MiraFeld may suspend or restrict access to the Site at any time where reasonably necessary.

11. Third-Party Services

The Site may use third-party services, including payment processors, hosting platforms, and analytics providers.

Your use of those services may also be subject to their own terms and policies.

12. Privacy

Your personal information is handled in accordance with the MiraFeld Privacy Policy.

By using this site you acknowledge that your personal information will be handled in accordance with our Privacy Policy (including any overseas disclosures described there) 

13. Limitation of Liability

To the maximum extent permitted by law:

  • MiraFeld is not liable for any indirect, incidental, or consequential loss; and

  • MiraFeld’s liability is limited to the amount paid for the relevant Product.

Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you have under Australian Consumer Law.

Where liability cannot be excluded, it is limited to the minimum extent permitted by law, including (where applicable) the resupply of goods or services or the cost of resupply.

14. Termination

MiraFeld may suspend or terminate access to the Site or any licence where:

  • these Terms are breached;

  • a licence is misused; or

  • unlawful or unauthorised activity is suspected.

Upon termination, you must cease all unauthorised use of any Product.

15. Future Services

MiraFeld may offer additional services in the future, including custom commissions.

Such services may be subject to separate terms.

16. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia.

You agree that any disputes arising in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of New South Wales.

17. Changes to These Terms

MiraFeld may update these Terms from time to time.

Updated Terms will be published on the Site with the revised effective date.
